Justice Stephen Daylop-Pam of the Federal High Court sitting in Port Harcourt has struck out two (2) separate suits filed by the Peoples Democratic Party (PDP) challenging the eligibility of candidates of the Accord Party to contest the 2023 general elections in Rivers State for lack of jurisdiction.
The Court held in the first case that, it cannot stop the Accord Party's Governorship candidate, Dumo Lulu-Briggs and his running mate based on decisions of higher courts.
Justice Daylop-Pam applied the same judgement in another case in which the ruling PDP in Rivers State brought against all the National Assembly candidates of Accord, for same lack of jurisdiction.
The presiding judge who decided not to go into the merit of the case, said he based his judgments on the recent decisions of the Lagos Division of the Court of Appeal as well as the Port Harcourt Division, in which both Appellate Courts had held that no court has jurisdiction to entertain a case filed by another political party on issues bothering on internal party affairs.
Justice Daylop Pam therefore declared that any attempt by him to interfere in the matter after an Appellate court had decided on a similar subject, will amount to judicial rascality.
