Appeal Court Sets Nnamdi KANU Free.
The Court of Appeal in Abuja this Thursday ruled that the "extraordinary rendition of Nnamdi Kanu fro Kenya by the Nigerian government is declared, "illegal" and consequently constitutes a bar to further trail of the leader of the proscribed Indigenous People of Biafra (IPOB).
By the order, the Court has set Kanu free.
Nnamdi Kanu was standing trial for alleged treason and terrorism charges levied against him by the President Mohammadu Buhari government over his activities in the agitation for a separate Biafra nation.
The three-man Appeal Court panel held that the Federal High Court was wrong to have assumed jurisdiction to try Kanu in view of the abduction and extraordinary rendition to Nigeria.
The Justices said the Federal Government's action was in flagrant violation of the Organisation of African Unity (OAU) convention and protocol on extradition.
The Appeal Court therefore held that the 15-count charge preferred against Nnamdi Kanu did not disclose the place, date, time and nature of the alleged offences before being unlawfully extradited to Nigeria in clear violation of international treaties.
The lawyer to the IPOB leader, Nnamdi Kanu, Barrister Ifeanyi Ejiofor confirmed the Court of Appeal judgement to journalists in Abuja.
